What Is The VICP?
The National Vaccine Injury Compensation Program (VICP) is a special federal program that provides compensation for people who have suffered injuries or adverse reactions caused by certain vaccines. It was created by Congress in 1986 to ensure that individuals harmed by vaccines can receive fair financial relief without having to file traditional lawsuits against vaccine manufacturers or healthcare providers.
At Pearsall Law Firm, P.C., we help individuals and families across the United States navigate this unique process through the U.S. Court of Federal Claims, also known as “Vaccine Court.”
Why the VICP Was Created
Before 1986, people who suffered vaccine injuries could only pursue traditional product liability lawsuits against vaccine manufacturers. A wave of lawsuits in the 1970s and 1980s led to vaccine shortages and higher prices. To stabilize the vaccine supply and provide a fair compensation system, Congress established the VICP.
The program is funded by a small excise tax on each vaccine dose that the vaccine manufacturers pay, and is designed as a no-fault system — meaning you don’t have to prove fault or negligence to recover possibly substantial compensation of $250,000 or more.
How the VICP Works
VICP claims are filed in the U.S. Court of Federal Claims in Washington, D.C. Instead of a jury, your case is heard by a Special Master, a judge experienced in vaccine law. The government, represented by the Department of Justice and the Department of Health and Human Services (HHS), reviews the petition and medical evidence.
Depending on the evidence, cases can end in:
Concession: The government agrees the vaccine caused the injury.
Settlement: Both sides agree on compensation.
Hearing: The Special Master decides the case after reviewing evidence and testimony.
What Compensation Is Available
Successful claims may include compensation for:
Medical and rehabilitation expenses
Lost wages and future income loss
Pain and suffering (up to $250,000)
Future care and life-care planning for severe injuries
All awards are tax-free, and your attorney’s fees are paid directly by the VICP — not out of your compensation.
Why Choose Pearsall Law Firm, P.C.
The VICP has its own rules, procedures, and strict deadlines — typically three years from the first symptom of injury or two years from death in fatal cases. Missing these deadlines will often permanently stop your claim, no matter how strong the evidence is.
At Pearsall Law Firm, P.C., we:
Represent clients nationwide before the U.S. Court of Federal Claims
Handle all medical record collection and filings
Work with trusted medical experts to strengthen your case
Ensure every deadline and technical requirement is met
