Case No. 20-0332v: $225,000 Award

This case involved a healthy, active 70-year-old who developed symptoms of numbness and weakness in the limbs shortly after receiving a seasonal flu vaccine.

Within weeks, the rapidly progressing paralysis required hospitalization, a ventilator, and a feeding tube for four months. Recovery was long and difficult, and included lasting neurological damage that left our client unable to live independently.

Case No. 19-198v: $150,000 Award

This case involved a military veteran who was seriously injured after a seasonal flu vaccination. Before the illness, our client was healthy, active, and working as a park ranger. Within weeks of vaccination, our client began experiencing weakness and numbness in the legs that rapidly progressed to near-total paralysis.

Misdiagnosed at first, our client was eventually hospitalized and struggled with pneumonia, kidney failure requiring dialysis, multiple ICU admissions, feeding tubes, and extensive rehabilitation.

  • You generally have three years from the first symptom of your vaccine injury to file a claim.

    For death cases, you have two years from the date of death and no more than four years from the first symptom of the illness that led to death.

    These deadlines are strict — if you miss them, your case cannot be filed, no matter how much evidence you have, even if the evidence itself falls within the deadline. The key is when the claim was filed, not when the evidence was created or collected.

    At the same time, an injury is generally not considered “severe” enough to be eligible for compensation until 6 months have passed or until a hospitalization has taken place.

    This is a tight balancing act to walk, so the best way to walk it is by working with an experienced vaccine law firm like ours.
