Every year, the U.S. Department of Health and Human Services releases data about the National Vaccine Injury Compensation Program (VICP)—and the numbers tell an important story.

After several years of decline, VICP payouts increased significantly in 2021, rising from just under $187 million in 2020 to more than $208 million—the fourth-highest total of the past decade. Since its creation, the VICP has awarded over $4.3 billion in compensation across 8,500 cases, with an average award of roughly $500,000 per successful claim. When you include attorney fees paid directly by the program, total payments have exceeded $4.7 billion.

Flu shot injuries remain by far the most common, making up more than one-third of all claims filed since 1988. The vast majority involve SIRVA (shoulder injury related to vaccine administration)—an injury caused by incorrect injection technique rather than the vaccine itself.
At the same time, the Vaccine Court dismissed more claims than usual in 2021, rejecting 241 petitions. This underscores the importance of skilled legal representation.
