What Vaccines Are Covered Under the VICP?
The National Vaccine Injury Compensation Program (VICP) was created to ensure that individuals harmed by routine vaccines have a fair, efficient way to seek compensation without having to sue a doctor or vaccine manufacturer directly. But not every vaccine is covered by the program. At Pearsall Law Firm, P.C., we help clients understand exactly which vaccines qualify—and what kinds of injuries may be compensated under the law.
The VICP covers “covered vaccines,” which are listed on what’s known as the Vaccine Injury Table. This table is maintained by the U.S. Department of Health and Human Services and identifies both the vaccines and the specific injuries (“on-table” injuries) that qualify for compensation.
You can also file for “off-table” injuries—those not specifically listed—but those cases require stronger medical and legal evidence to prove a connection between the vaccine and the injury.
Here’s a summary of the vaccines that are currently covered under the VICP, based on the latest table published in 2022:
Diphtheria, Tetanus, and Pertussis (DTaP, Td, TT) — Covers injuries like anaphylaxis, brachial neuritis, encephalopathy, and SIRVA.
Measles, Mumps, and Rubella (MMR, MMRV) — Covers anaphylaxis, encephalopathy, thrombocytopenic purpura, and vaccine-strain measles.
Influenza (Flu Shot) — Covers anaphylaxis, Guillain-Barré Syndrome (GBS), SIRVA, and fainting (vasovagal syncope).
Hepatitis A and B Vaccines — Covers SIRVA, vasovagal syncope, and anaphylaxis.
Human Papillomavirus (HPV) — Covers SIRVA, vasovagal syncope, and anaphylaxis.
Meningitis, Pneumococcal, Polio, Rotavirus, and Varicella (Chickenpox) Vaccines — Each covers specific injuries such as intussusception (for rotavirus), vaccine-strain varicella (for chickenpox), and paralytic polio (for oral polio vaccine).
In addition, the program automatically adds new vaccines recommended by the CDC for children or pregnant women, once they’re published in the Federal Register. However, as of now, no new vaccines have been added since 2022.
It’s important to note that COVID-19 vaccines are not currently covered under the VICP. Claims involving COVID-19 vaccines fall under a separate program called the Countermeasures Injury Compensation Program (CICP), which has far stricter requirements and offers limited benefits.
